General Terms and Conditions General Terms and Conditions of Foggy Yami KV s.r.o. with registered office at Kr\u00e1le Ji\u0159\u00edho 1266\/34, 36001, Karlovy Vary, ID No. 19384301 For the purposes of these General Terms and Conditions, the following terms shall have the following meanings: \u201cSeller\u201d means Foggy Yami KV s.r.o. with its registered office at 1266\/34 Kraje Ji\u0159\u00edho, 36001, Karlovy Vary, ID No. 19384301, and its registered office at \u201cFoggyyami\u201d, Belehradska 1094\/4, 36001 Karlovy Vary \u201cPrice List\u201d means the price list issued by the Seller, which determines the prices of individual types of Goods. The Price List is published on the Seller's website foggyyami-kv.cz. \u201cPurchase Price\u201d means the price of the Goods calculated by the Seller as a multiple of the Goods delivered to the Buyer and the price of the Goods determined by the Price List. \u201cBuyer\u201d means a natural or legal person who enters into a purchase contract with the Seller for the supply of Goods by means of a binding order. \u201cGoods\u201d means the Seller's products offered on the foggyyami-kv.cz website.   • The Seller undertakes to manufacture the Goods in accordance with the Buyer's order, to transport the Goods to the Buyer at the Buyer's expense to the place designated by the Buyer and to deliver the Goods to the Buyer in the manner set out in paragraph 2 of this Article.<\/li>
    \n \t
  • The Seller undertakes to inform the Buyer about the current offer of the Goods through the menu published on the Seller's website foggyyami-kv.cz and the current price of the Goods through the Price List published on the Seller's website foggyyami-kv.cz.<\/li>
    \n \t
  • The Seller undertakes to produce the Goods in accordance with the applicable standards and regulations of the Czech Republic using quality and fresh raw materials and further undertakes to inform the Buyer about the composition of the Goods in accordance with applicable law. The Seller shall communicate this information to the Buyer via the website foggyyami-kv.cz.<\/li>
    \n \t
  • The goods are delivered chilled and warm. The goods must be kept cool until consumed. The Seller shall not be liable for the quality of the Goods if the storage conditions are breached after the Goods have been handed over to the Buyer. Goods must be consumed within 5 hours of delivery. Once opened, the Goods must be consumed immediately.
    \nPAYMENT AND TRANSPORT<\/li>
    \n \t
  • The buyer can make payment on our e-shop via payment gateway and also by card via payment terminal at the pick-up at the shop. Or in cash on pick up at the shop or by courier on delivery.<\/li>
    \n \t
  • With any payment method, the buyer will receive a receipt from us for payment.<\/li>
    \n \t
  • Transport options<\/li>
    \n \t
  • Delivery of goods by courier or Pick up of goods at the premises Belehradska 1094\/4, 36001 Karlovy Vary.<\/li>
    \n \t
  • The driver delivers the goods to the Buyer regularly in the evening between 12:00 and 00:00, the maximum delivery time of 120 minutes from the moment of order creation. After exceeding these delivery times, the buyer can request a refund of 50% of the price of the goods. The driver delivering the goods shall hand over the goods to the Buyer, a person designated by the Buyer or another person present at the place designated by the Buyer as the place of delivery of the goods. If there is no person at the place designated by the Buyer as the place of delivery of the goods to whom the goods may be handed over, the goods shall be delivered to the collection point at Belehradska 1094\/4, 36001 Karlovy Vary, for personal collection by the Buyer. The moment the goods are handed over to the Buyer, the risk of damage to the goods shall pass to the Buyer.
    \nORDER<\/li>
    \n \t
  • The order of goods can be made in the following way: a) by calling +420 737 094 887, b) through the online form located on the website foggyyami-kv.cz, c) through the social network listed on the website foggyyami-kv.cz<\/li>
    \n \t
  • The order must be placed at least 23:45 hours before the delivery. Each order made is a binding proposal for the conclusion of a purchase contract.
    \nCOMPLAINTS POLICY<\/li>
    \n \t
  • Changes or cancellations made within 10 minutes of placing the order by phone at +420 737 094 887.<\/li>
    \n \t
  • When cancelling an order within 10 minutes of creating the order, the buyer can request a refund, on account of which he must send us an email to foggy.yami.kv@gmail.com, and the money will be refunded within 7 working days, but in that case, the seller is entitled to charge a penalty of 100 CZK with VAT per order.<\/li>
    \n \t
  • If the goods have been delivered or collected, they cannot be returned.<\/li>
    \n \t
  • If the goods have not yet been delivered or picked up, you can return (leave) the goods at the premises or with a courier.<\/li>
    \n \t
  • According to the Sales Records Act, the seller is obliged to issue a receipt to the buyer. At the same time, he is obliged to register the received sales with the tax administrator online; in case of technical failure, within 48 hours at the latest.
    \nPURCHASE PRICE<\/li>
    \n \t
  • The Buyer undertakes to take over the ordered goods from the Seller at the place designated by the Seller, including in the manner specified in Article II, paragraph 2 of these Conditions, and to pay the Seller the Purchase Price for the goods in due and timely manner.<\/li>
    \n \t
  • If the buyer has an ID number, he is entitled to request an invoice under a variable symbol and to pay the purchase price by wire transfer to the seller's account. The Seller shall invoice the Purchase Price to the Buyer with an invoice with a due date within 4 days from the date of the invoice. The Seller is entitled to issue an invoice to the Buyer on the day the Client orders the goods and sends the invoice to the Buyer by e-mail. In the case of payment of the purchase price by wire transfer, the purchase price shall be deemed to be paid at the moment of its crediting to the Seller's bank account.<\/li>
    \n \t
  • In the case of payment of the purchase price in cash or by card to the delivery driver upon receipt, the driver shall issue the buyer a tax receipt for the amount of the purchase price received, indicating the tariff for which the buyer has paid the purchase price.<\/li>
    \n \t
  • In the event of delay in payment of the purchase price, the seller may require the buyer to pay interest on the delay.<\/li>
    \n \t
  • In the event of default in payment of the purchase price, the Seller may refuse delivery of the ordered goods until full payment of the purchase price for previous deliveries of the goods.<\/li>
    \n \t
  • In the event of default in payment of the purchase price, the Seller is entitled to forward the Buyer's details to the representing law firm for the purpose of recovering the amount.
    \nDATA PROTECTION AND STORAGE OF COOKIES<\/li>
    \n \t
  • The Buyer agrees to the processing of the following personal data: name and surname, home address, identification number, tax identification number, e-mail address, telephone number and home address (hereinafter collectively referred to as \u201epersonal data\u201c).<\/li>
    \n \t
  • The Buyer agrees to the processing of personal data by the Seller for the purposes of exercising the rights and obligations under the Purchase Agreement, for the purposes of maintaining the user account and transporting the goods. Unless the Buyer chooses otherwise, the Buyer also agrees to the processing of personal data by the Seller for the purpose of sending information and commercial communications to the Buyer.<\/li>
    \n \t
  • The Buyer acknowledges that he\/she is obliged to provide his\/her personal data (when placing an order from the web interface of the shop) correctly and truthfully and that he\/she is obliged to inform the Seller without undue delay of any change in his\/her personal data.<\/li>
    \n \t
  • The seller may entrust a third party as a processor to process the buyer's personal data. Except for employees of the company and persons transporting or issuing goods, personal data will not be passed on by the seller to third parties without the prior consent of the buyer.<\/li>
    \n \t
  • Personal data will be processed for an indefinite period of time. Personal data will be processed in electronic form by automated means or in paper form.<\/li>
    \n \t
  • The Buyer confirms that the personal information provided is accurate and that he\/she has been advised that this is a voluntary disclosure<\/li>
    \n \t
  • Should the Buyer believe that the Seller or Processor is processing his\/her personal data in a way that is contrary to the protection of the Buyer's private and personal life or contrary to the law, in particular if the personal data are inaccurate with regard to the purpose of their processing, he\/she may: o ask the Seller or Processor for an explanation, o demand that the Seller or Processor remedy the situation.
    \nSENDING COMMERCIAL COMMUNICATIONS<\/li>

  • The Buyer agrees to receive information related to the Seller's goods, services or business at the Buyer's electronic address and via SMS messages and further agrees to receive commercial communications from the Seller at the Buyer's electronic address and via SMS messages.<\/li>
